GPU-Capable End-Use & End-User Statement

Required by Vipera LLC prior to delivery of GPU-capable systems and advanced computing platforms, including chassis that may later be configured with GPUs or advanced integrated circuits.

Please complete all required information accurately. This statement is required by Vipera LLC prior to delivery of GPU-capable systems and advanced computing platforms.

Order and End-User Information

Provide the purchase, end-user, installation, and intended workload information.

Restricted-Party and Restricted-Destination Disclosure

Please disclose whether the end-user or any contemplated downstream party is subject to applicable U.S. restrictions.

Is the End-User, or any contemplated consignee, intermediate consignee, or downstream purchaser, (a) headquartered, organized, or located in a U.S. comprehensively-embargoed or sanctioned territory, including Cuba, Iran, North Korea, Syria, Russia, Belarus, and the Crimea, Donetsk, and Luhansk regions of Ukraine; or (b) listed on, or owned 50% or more by parties listed on, any U.S. Government restricted-party list, including the BIS Entity List, Denied Persons List, Unverified List, Military End-User List, or OFAC SDN List?

Is the End-User or any contemplated party subject to the restricted-party or restricted-destination conditions described above?

Future GPU or Advanced IC Integration

Identify whether a GPU, advanced integrated circuit, or other advanced computing component may subsequently be installed.

Will any GPU, advanced integrated circuit, or other advanced computing component subsequently be installed into the products being supplied under this transaction?

The End-User acknowledges that all transactions under this order are subject to United States export control laws and regulations, including the Export Administration Regulations (EAR, 15 CFR Parts 730–774) and sanctions programs administered by the U.S. Office of Foreign Assets Control.

The subsequent installation of a GPU or advanced integrated circuit may alter the classification of the resulting system and may, based on total processing performance, performance density, or other technical thresholds, subject the system to additional export licensing requirements, including under the Framework for Artificial Intelligence Diffusion published January 13, 2025.

The undersigned certifies that the foregoing is true and correct to the best of their knowledge and that they have lawful authority to sign on behalf of the End-User named below.
